Legal Advisor (Zabul, Afghanistan)


Job Description

To ensure efficient and correct implementation of case management activities for CP cases, GBV survivors and People with Specific Needs (PwSN) among the IDPs, Returnees and host communities. To act according to the guiding principles of case management including using a survivor-centered approach, confidentiality, safety, do not harm and non-discrimination. To ensure that protection principles are understood, maintained and enforced.

 

Duties and Responsibilities:

  • Ensure the organization and the implementation of all protection activities at field level in accordance with the agreed work plan under the supervision of Protection Activity Manager.
  • Provide legal counselling (GBV, Civil documentation and legal issue) and mediation in support of the Case Management team, conduct basic interviews with the Individual Cases in order to assess legal and urgent protection needs of the Person Of Concern (PoC).
  • Provide information during information sessions or awareness raising session to targeted population on GBV, rights, entitlements, available services, civil documentation and other necessary protection information.
  • Represent client Infront of legal department on need basis.
  • Oversee actors and service mapping and development of referral pathways and ensure that all the program and monitoring documents which needs to be completed in the field are filled in as per guidelines and submitted
  • Provide individual legal counseling on legal issues (Afghan Personal Law, Afghan Criminal law and International Human Rights) to beneficiaries approaching the INTERSOS teams and Community Outreach Volunteers (COVs) or being referred internally by INTERSOS Social Workers or other service providers.
  • To train Community Outreach Volunteers (COVs) on the related topics and work on their capacity building.
  • When necessary and upon PoC consent, provide legal guidance to people who are in need for urgent and legal protection. Services include legal advice, mediation between the two conflict parties and with the tribal or community leaders. , prosecution and legal representation within the Afghan court or traditional system.
  • Undertake regular follow up visits to PoC; including in detention facilities, in courts or in police stations when needed.
  • Follow up all relevant cases according to the type of the accusation of the PoC, i.e.: labour, inheritance cases, Civil documentation cases.
  •  criminal, detention, protection and traffic cases.
  • Attend meetings and workshop/training as requested by the supervisor.
  • Ensure regular collection, analysis and internal dissemination of protection information
  • Inform the supervisor of the individual progressive legal cases conditions on a weekly basis.
  • Participate in legal awareness sessions for the IDPs and host community as well as AoGs, local authorities and security establishment where relevant.
  • Take part in the Legal Case Management Coordination meetings with other protection actors providing case management services as requested by the supervisor.
  • Representation of INTERSOS Protection in relevant meetings at field level as delegated by management
  • Participate in detention monitoring meetings.
  • Any other duties as assigned by the supervisor.

 

Reporting

Provide daily updates to the supervisor about new cases assessed.

Deliver weekly and monthly written reports or any kind of urgent report (emergency cases) to supervisor.

File and report in detail on all cases with relevant information about the case, background, case plan, follow up and actions taken.

Provide to the supervisor a bi-weekly and monthly reports on the activities conducted.

 

Meetings and Trainings

Participates in meetings and trainings in and outside the centres including case management meetings and case conferences.

Participates in daily staff meetings.

Participates in weekly internal case management meetings for GBV and PwSN.

Job Requirements

Bachelor’s degree in law and Valid AIBA License is required.

3+ years of relevant work experience at least in the legal field.

To have Valid AIBA License is an asset.

English, Pashto and Dari skills are required.

Essential computer literacy (word, excel and internet).

Work experience in Protection in emergency response projects is preferable.

Previous experience working for an international NGO is preferable.

Commitment to INTERSOS principles.

Comply with all relevant INTERSOS policies and procedures.

Demonstrable experience in establishing and maintaining collaborative relationships with government counterparts.

Strong organizational and communication skills, with the ability to effectively present information and respond appropriately to questions from supervisor in the field.

Ability and willingness to travel  and stay overnight at service delivery point.
